Canada YC Music Academy is committed to providing a high-quality educational experience to all our students. In alignment with the amendments to the Private Training Regulation (PTR) and our dedication to transparency and fairness, we outline below the Student Statement of Rights.

As a student at Canada YC Music Academy, you have the right to:

  • Receive Quality Education: Access to programs and courses that meet high educational standards.

  • Be Informed: Clear and accurate information about our programs, including course requirements, tuition fees, refund policies, and any additional costs.

  • Fair Treatment: A learning environment that is free from discrimination, harassment, and any form of unfair treatment.

  • Privacy and Confidentiality: Protection of your personal information and records in accordance with privacy laws.

  • Academic Freedom: Express your ideas and opinions respectfully within the academic setting without fear of retribution or unfair treatment.

  1. If [Canada Y.C. Music Academy] receives tuition from the student, or a person on behalf of the student, the institution will refund the student, or the person who paid on behalf of the student, the tuition that was paid in relation to the [String Instruments Performance Diploma or  Plucked Instruments Performance Diploma  ] in which the student is enrolled if:
    1. the institution receives a notice of withdrawal from the student no later than seven days after the effective contract date and before the contract start date;
    2. the student, or the student’s parent or legal guardian, signs the student enrolment contract seven days or less before the contract start date and the institution receives a notice of withdrawal from the student between the date the student, or the student’s parent or legal guardian, signed the student enrolment contract and the contract start date; or
    3. the student does not attend a work experience component and the institution does not provide all of the hours of instruction of the work experience component within 30 days of the contract end date.
  2. [Canada Y.C. Music Academy] will refund the tuition for the [String Instruments Performance Diploma or  Plucked Instruments Performance Diploma] and all related fees paid by the student or a person on behalf of the student enrolled in the program if the student is enrolled in the program without having met the admission requirements and did not misrepresent his or her knowledge or skills when applying for admission.
  3. If a student does not attend any of the first 30% of the hours of instruction to be provided during the contract term, [Canada Y.C. Music Academy] may retain up to 50% of the tuition paid under the student enrolment contract unless the program is provided solely through distance education.
  4. Unless the [String Instruments Performance Diploma or  Plucked Instruments Performance Diploma] is provided solely through distance education, if [Canada Y.C. Music Academy] receives a notice of withdrawal from a student:
    1. more than seven days after the effective contract date and
      1. at least 30 days before the contract start date, the institution may retain up to 10% of the tuition due under the student enrolment contract, to a maximum of $1,000.
      2. less than 30 days before the contract start date, the institution may retain up to 20% of the tuition due under the student enrolment contract, to a maximum of $1,300.
    2. after the contract start date
      1. and up to and including 10% of the hours of instruction to be provided during the contract term have been provided, the institution may retain up to 30% of the tuition due under the student enrolment contract.
      2. and after 10% but before 30% of the hours of instruction to be provided during the contract term have been provided, the institution may retain up to 50% of the tuition due under the student enrolment contract.
  5. Unless the [String Instruments Performance Diploma or  Plucked Instruments Performance Diploma] is provided solely through distance education, if [Canada Y.C. Music Academy] provides a notice of dismissal to a student and the date the institution delivers the notice to the student is:
    1. equal to or before 10% of the hours of instruction to be provided during the contract term have been provided, the institution may retain up to 30% of the tuition due under the student enrolment contract.
    2. after 10% but before 30% of the hours of instruction to be provided during the contract term have been provided, the institution may retain up to 50% of the tuition due under the student enrolment contract.
  6. If [Canada Y.C. Music Academy] provides the [String Instruments Performance Diploma or  Plucked Instruments Performance Diploma] solely through distance education and the institution receives a student’s notice of withdrawal or the institution delivers a notice of dismissal to the student and:
    1. the student has completed and received an evaluation of his or her performance for up to 30% of the hours of instruction to be provided during the contract term, the institution may retain up to 30% of the tuition due under the student enrolment contract, or
    2. the student has completed and received an evaluation of his or her performance for more than 30% but less than 50% of the program, the institution may retain up to 50% of the tuition due under the student enrolment contract.
  7. [Canada Y.C. Music Academy] will refund fees charged for course materials paid for but not received if the student provides a notice of withdrawal to the institution or the institution provides a notice of dismissal to the student.
  8. Refunds required under this policy will be paid to the student, or a person who paid the tuition or fees on behalf of the student, within 30 days:
    1. of the date [Canada Y.C. Music Academy] receives a student’s notice of withdrawal,
    2. of the date [Canada Y.C. Music Academy] provides a notice of dismissal to the student,
    3. of the date that the registrar provides notice to [Canada Y.C. Music Academy]that the institution is not complying with section 1(c) or 2 of this policy, or
    4. after the first 30% of the hours of instruction if section 3 of this policy applies.
  9. If an international student delivers a copy of a refusal of a study permit to [Canada Y.C. Music Academy], sections 1(a), 1(b), 4, 7,Error! Reference source not found. and 8 of this policy apply as if the copy of the refusal were a notice of withdrawal, unless:
    1. the international student requests an additional letter of acceptance for the same program that was the subject of the refusal of a study permit, 

or the [String Instruments Performance Diploma or  Plucked Instruments Performance Diploma] is provided solely through distance education.

The success of the College Program requires regular and punctual attendance at all scheduled classes.  Students are required to notify the teachers in advance if they are unable to attend class, either in person or by email.

    1. Canada YC Music Academy is committed to the prevention of and appropriate response to sexual misconduct. This policy applies to the students in case of any kind of sexual misconduct at the Academy of Learning or at any event organized by the college. It also includes faculty, staff, administration, Board members, contractors, volunteers, visitors, and others identified by the institution.
    2. Canada YC Music Academy intends to provide a safe and secure learning environment to prevent such incidents and to provide support to the students in making a disclosure/complaint or report if such incidents occur. Further, the college will treat the individuals who will report the incidents of sexual harassment with dignity and respect. The academy also aims to educate the academy community about prevention of sexual misconduct.
    3. Sexual misconduct refers to a spectrum of non-consensual sexual contact and behaviourincludingthe following:
    • sexual assault;
    • sexual exploitation;
    • sexual harassment;
    • stalking;
    • indecent exposure;
    • voyeurism;
    • the distribution of a sexually explicit photograph or video of a person to one or more persons other than the person in the photograph or video without the consent of the person in the photograph or video and with the intent to distress the person in the photograph or video;
    • the attempt to commit an act of sexual misconduct; and
    • the threat to commit an act of sexual misconduct.
    1. A person may choose to Disclose or Complain at the college of an incident of sexual misconduct without making a formal report to police or campus authorities.
    2. A Report is a formal notification of an incident of sexual misconduct to someone at the academy accompanied by a request for action. A report can be made by anyone including, but not limited to, the victim/survivor.
    3. A student making a Complaint will be provided with resolution options and, if appropriate, accommodation, and will not be required or pressured to make a Report.
    4. The process for making a Complaint about sexual misconduct involving a student is as follows:

      Canada Y.C. Music Academy  immediate reporting of the incidents of sexual misconduct by those who have knowledge of or who have witnessed.

      The students can make complaints to their instructor or the Senior Educational Administrator (SEA) who is responsible for making determinations in respect of complaints.

    1. The process for responding to a Complaint of sexual misconduct involving a student is as follows:
    • Upon the complaint about the sexual harassment incident, the SEA will immediately take a notice.
      The institution will acknowledge receipt of the complaint within three business days.
    • After receiving a complaint, the college will provide the victim/survivor all necessary information on available resources and support.
    • The SEA will ensure fair treatment with the both parties involved.
    • The SEA will arrange a meeting with the complainant to collect the necessary information about the incident and to assist the complainant to take appropriate steps.
    • The SEA may provide emergency numbers for on and off campus security, law enforcement, medical assistance, and mental health services (if required).
    • The SEA will encourage immediate reporting of the incident and will ensure the safety of the students after the incident.
    • A complaint may not result in a report being made and, therefore, may not initiate a formal process.
    • The consent of the complainant is important to disclose and report the matter for further investigations.
    • The complainant may change his/her mind later on and choose to report to police or campus security.
    1. The process for making a Report of sexual misconduct involving a student is as follows:

    1. The process for responding to a Report of sexual misconduct involving a student is as follows:
    • The SEA or Campus Director will respond to the report as soon as possible, within three business days from the submission of the report.
    • The SEA will meet the victim/survivor and interview them.
    • Interview the witnesses (if available) of that incident to collect the facts.
    • Interview any other person who may have knowledge of the incident related to the complaint.
    • Determine the date of the incident, time of the incident, the persons involved and any witness of the incident etc.
    • After the preliminary investigation which will take a maximum of 5 business days, the SEA will inform the complainant about the progress and provide a chance to the respondent to respond to the allegations.
    • If the individual filing a report to the college will withdraw the report, the institution may continue to act on the matter (if required for the safety of the students).
    • Further, the SEA can also consult with other institution departments (e.g. Human Resources, Disability Services, International Programs, Security), police, community-based victim services programs, or other experts as required.
    • The academy may inform the campus security about the incident for the safety purposes.
    • The SEA will determine the appropriate disciplinary action after the investigation if any should be taken.

    (1) Determine that the report is not proved; the file is closed.

    (2) Determine that the report is substantiated, in whole or in part, and either:

    (i) Give the student a warning clearing up the consequences of further misconduct; or

    (ii) Set a probationary period with appropriate conditions; or

    (iii) Recommend that the student should be dismissed from the academy. 

    • The SEA will determine the severity of the incident and can refer to police if needed.
    • A victim/survivor may also wish to make a formal report of an incident of sexual misconduct to police.
    • The complainant can also make an anonymous report to the police about the incident, through a community-based victim support worker without disclosing his/her name or contact numbers. This anonymous report would be sent to campus security by the Community Victim Service Agency.
    1. It  is contrary to this policy for Canada Y.C. Music Academy to retaliate,engage in reprisalsor threaten to retaliate in relation to a Complaint or a Report.
    2. Any processes undertaken pursuant to this policy will be based on the principles of administrative fairness. All parties involved will be treated with dignity and respect.
    3. All information related to a Complaint or Report is confidential and will not be shared without the written consent of the parties, subject to the following exceptions:

    If an individual is at imminent risk of severe or life-threatening self-harm.
    If an individual is at imminent risk of harming another.
    There are reasonable grounds to believe that others in the institutional community may be at significant risk of harm based on the information provided.
    Where reporting is required by law.
    Where it is necessary to ensure procedural fairness in an investigation or other response to a Complaint or Report.

    Disciplinary Procedures

    Canada Y.C. Music Academy  will act according to its policies to investigate the incidents related to the sexual harassment. Canada Y.C. Music Academy  will take disciplinary action, if the college management determines that any student or staff member of the college is involved in sexual misconduct. This disciplinary action may include warning or termination of the employee/ dismissal of the student. Canada Y.C. Music Academy  will not tolerate any form of sexual misconduct. 

    Canada Y.C. Music Academy respects the privacy and fair treatment rights of the victims/survivors and suspected perpetrators as such incidents have serious impacts on the physical, mental, and emotional health of the victim/survivor. The academy responds to the harassment incidents based on the victims/survivor’s consent and the severity of the incident.

    This institution is certified by the Private Training Institutions Branch (PTIB). Certified institutions must comply with regulatory requirements, including the requirement to have a Sexual Misconduct policy. For more information about PTIB, go to www.privatetraininginstitutions.gov.bc.ca.


    ROLES AND RESPONSIBILITIES

    The Executive Director (ED) is responsible for ensuring implementation of the policies programs and practices for the prevention of and the response to sexual misconduct. ED will get help and assistance from SEA, staff within health/wellness and/or counselling centers in BC, any security organization, or other senior administrators responsible for student services, residence managers, etc. CYCMA has Response Team consisting upon SEA, Recruitment & Admission Manager and one senior staff member who is responsible safety and security at the Campus.

    Note: In case SEA and Campus Director is same person, or SEA or Campus Director is party in the issue, communication with Campus Director will be directed to Executive Director. 

  1. The Canada Y.C. Music Academy is committed to ensuring that its learning environment promotes the respectful and fair treatment of all students.

    The Canada YC music academy is committed to ensuring that its learning environment promotes the respectful and fair treatment of all students. CYCMA has a responsibility to provide a safe and civil environment for students; appropriate behavior is expected from students, administrators, faculty, staff and volunteers.  While on YCMA premises or during activities or events hosted by CYCMA, bullying, harassment, intimidation, and discrimination are prohibited.

    Bullying, harassment, intimidation, or discrimination means any gesture or written, verbal or physical act that takes place on school property, or at any school-sponsored function that: a) is motivated by any actual or perceived characteristic, such as race, color, religion, ancestry, national origin, gender, sexual orientation, gender identity and expression, or a mental, physical or sensory disability; and, b) a reasonable person should know, under the circumstances, that the act(s) will have the effect of harming a student or damaging the student’s property, or placing a student in reasonable fear of harm to his person or damage to his property; or c) has the effect of insulting or demeaning any student or group of students in such a way as to cause substantial disruption in, or substantial interference with, the orderly operation of the school.

     

    While on Canada Y.C. Music Academy premises or during activities or events hosted by Canada Y.C. Music Academy the following activities are prohibited:

    If you wish to report an incident of improper behavior at CYCMA, you should contact either the College Registrar at(email), or the Senior Education Administrator at (email).  All conversations will be strictly confidential.  CYCMA will not, in any way, retaliate against any individual who, in good faith, makes a complaint or report of improper behavior, or participates in the investigation of such a complaint or report.

    The Senior Education Administrator will determine which course of action or punishment is necessary, as outlined in CYCMA’s Standard of Conduct Policy.

     

    If under any circumstances, a prohibited activity occurs, the following outlines the process for addressing the activity:

    When a concern arises, the student should first attempt to address it with the individual most directly involved.  If unsatisfied with the outcome, the student should submit a written complaint to the College Registrar within thirty days.  Should this person be absent or be named in the complaint the student should submit the written complaint to the Executive Director.

    The College Registrar or Executive Director will arrange to meet with the student to discuss the concern as soon as possible and within 10 days of receiving the student’s written complaint.  Following the meeting with the student, the College Registrar or Executive Director will conduct whatever inquiries and/or investigations are necessary and provide a written response to the student that includes reasons for the determination on the complaint.  The written reasons will be provided no later than 21 days following the receipt of the student’s written complaint.

    Students making a complaint may be represented by an agent or a lawyer.  Students will not be subject to any retaliation as a result of their complaint.  After exhausting the dispute resolution process, a student may file a claim with the Private Training Institutions Branch (PTIB) of the Ministry of Advanced Education (www.privatetraininginstitutions.gov.bc.ca) on the basis that the institution misled the student regarding any significant aspect of an approved program.

  1. YCMA may dismiss a student from a program on any of the following grounds:

 

  • All students are expected to maintain a professional attitude toward their performance and classroom commitments. Regular punctual attendance at and preparation for rehearsals and classes are crucial to the attainment of professional artistic goals.  It is expected that the students will conduct themselves in a manner that does not discredit in any way and that they avoid all forms of dishonesty, including cheating and plagiarism.  Our college reserves the right to dismiss any student who does not pay fees or deliberately acts to prevent the holding of any class, lesson, rehearsal or performance.

 

  • While on premises or in the course of activities or events hosted by our college, students:

 

  1. must comply with all applicable college policies, including the Attendance Policy;
  2. must treat all students and staff with respect and must not engage in physically aggressive, threatening, harassing, discriminatory or otherwise offensive behavior;
  3. must not steal, misuse, destroy or deface college  property;
  4. must not consume, possess or distribute alcohol or controlled or restricted substances;
  5. must not contravene any provision of the Canadian Criminal Code or any other federal, provincial, or municipal statute or regulation.

 

  • Since student misconduct threatens the proper functioning of our college, penalties may include:

 

  1. a) Warning
  2. b) Rejection of submitted work
  3. c) Cancellation of scholarships
  4. d) Probation or suspension
  5. e) Expulsion from exam, the course, or the program
  6. f) Legal action

 

  1. The process by which a student may be dismissed from a program is as follows:
  • All concerns relating to student misconduct shall be directed to the Senior Education Administrator. Concerns may be brought by staff, students or the public.
  • The Senior Education Administrator CT Leung will arrange to meet with the student to discuss the concern(s) within 5 school days of receiving the complaint.  If the alleged conduct is of such a serious nature that an immediate dismissal may be warranted the Senior Education Administrator CT Leung will meet with the student as soon as possible.
  • Following the meeting with the student, the Senior Education Administrator CT Leung will conduct whatever further enquiry or investigation is necessary to determine whether the concerns are substantiated.
  • Any necessary inquiries or investigations shall be completed within 5 school days of the initial meeting with the student.
  • The Senior Education Administrator CT Leung will meet with the student and do one of the following:
  •          Determine that the concern(s) were not substantiated;
  •          Determine that the concern(s) were substantiated, in whole or in part, and either:
  •        Give the student a warning setting out the consequences of further misconduct;
  •                    Set a probationary period with appropriate conditions; or
  •                    Recommend that the student be dismissed from the Institution.
  • The Senior Education Administrator CT Leung will prepare a written summary of the determination.  A copy shall be given to the student, and the original will be placed in the student file.
  • If the student is issued a warning or placed on probation, the Senior Education Administrator CT Leung and the student both sign the written warning or probationary conditions, and the student is given a copy.  The original document is placed in the student’s file.
  • If the recommendation is to dismiss the student, the Senior Education Administrator CT Leung of the school will meet with the student to dismiss him or her from study at the school.  The head of the school Zhong Cai Yang will deliver to the student a letter of dismissal and a calculation of refund due or tuition owing, depending on the status of the student’s financial account with the school.
  • If a refund is due to the student, the head of school Zhong Cai Yang will ensure that a cheque is forwarded to the student within 30 days of the dismissal.
  • If the student owes tuition or other fees to the school, the head of the school Zhong Cai Yang may undertake the collection of the amount owing.

Dispute Resolution Process

At Canada YC Music Academy, we are committed to providing a supportive and fair learning environment. Recognizing that disputes may arise, we have established a clear and accessible process to resolve them efficiently and fairly. This process ensures that all parties involved have the opportunity to be heard and that resolutions are reached in a respectful and timely manner.

Step 1: Informal Resolution Attempt

  • Initial Communication: Students are encouraged to address their concerns directly with the party involved (e.g., faculty member, fellow student) to seek an informal resolution.
  • Support and Guidance: If needed, students can seek guidance from their program director or student services to facilitate this discussion.

Step 2: Formal Written Complaint

  • Submission of Complaint: If the issue cannot be resolved informally, students should submit a formal written complaint to the administration office. The complaint must include a detailed account of the issue, any attempts at informal resolution, and the desired outcome.
  • Acknowledgment: The academy will acknowledge receipt of the complaint within 5 business days and provide an estimated timeline for the review process.

Step 3: Investigation

  • Review and Investigation: The administration will review the complaint and may conduct an investigation, which could involve interviews with all parties involved and a review of relevant documents.
  • Fairness and Confidentiality: Throughout the investigation, the academy ensures confidentiality and fair treatment for all parties.

Step 4: Resolution and Response

  • Decision: After the investigation, the academy will make a decision based on the available evidence. This decision will be communicated to the student in writing, explaining the reasons behind the decision and any actions to be taken.
  • Timeframe: The academy aims to resolve all formal complaints within 30 days of receipt. If more time is required, all parties will be informed of the new timeline.

Step 5: Appeal

  • Grounds for Appeal: If the student is dissatisfied with the decision, they may appeal on specific grounds, such as procedural errors or new evidence. The appeal must be submitted within 10 business days after receiving the decision.
  • Appeal Review: An appeal committee not involved in the initial decision will review the appeal and make a final decision, communicated to all parties involved.

Step 6: External Resolution

  • Further Action: If the dispute cannot be resolved internally to the student’s satisfaction, they may seek external resolution through relevant educational or legal channels.
